US v. CANETE
G.R. No. L-11612, June 21, 1918
Facts:
Two informations were filed
in the trial court charging the fifty persons named in each information with
the crime of libel. The publication upon which the informations are based
consists of a charge in writing signed by appellants and their co-defendants in
the trial court, and addressed to the Roman Catholic Archbishop of Manila, in
which Father Acebedo, at that time a parish priest of which the defendants are
residents, is accused of maladministration, and misappropriation of the funds
and property of the church under his charge, drunkenness, taking indecent
liberties of the women of his congregation, illicit relations with the
complainant. Timotea Camposano.
The charges and petition for
the removal of Father Acebedo were taken by the appellant, Cañete to Manila.
The Catholic Archbishop of Manila rendered a decision for Father
Acebedo’s expulsion from membership as
church member.
Issue:
WON the decisions of the church tribunals can be reviewed by the Court.
Ruling:
No.
It is the established
doctrine of the American courts that in matters purely ecclesiastical the
decisions of the proper church tribunals are conclusive upon the civil
tribunals. A church member who is expelled from membership by the church
authorities, or a priest or minister who is by them deprived of his sacred
office, is without remedy in the civil courts, which will not inquire into the
correctness of decisions of the ecclesiastical tribunals. The right of such
ecclesiastical tribunals to try members offending against the canons of conduct
established by the church being thus recognized it is reasonable that their
decisions should be privileged, however derogatory they may be to the
reputation of the persons affected.
G.R. No. 204819, April 08, 2014
Facts:
Republic
Act (R.A.) No. 10354, otherwise known as the Responsible Parenthood and
Reproductive Health Act of 2012 (RH Law), was enacted by Congress on December
21, 2012. Shortly after the President placed his imprimatur on the said law,
challengers from various sectors of society came knocking on the doors of the
Court, beckoning it to wield the sword that strikes down constitutional
disobedience.
Petitioners
are assailing the constitutionality of RH Law contending that the RH Law
violates the right to life of the unborn. According to the petitioners,
notwithstanding its declared policy against abortion, the implementation of the
RH Law would authorize the purchase of hormonal contraceptives, intra-uterine
devices and injectables which are abortives, in violation of Section 12,
Article II of the Constitution which guarantees protection of both the life of
the mother and the life of the unborn from conception.
Respondent
contends that the intent of the Framers of the Constitution was simply
the prohibition of abortion. They contend that the RH Law does not violate the
Constitution since the said law emphasizes that only
"non-abortifacient" reproductive health care services, methods,
devices products and supplies shall be made accessible to the public.
Issue:
WON RH Law violates the right to life and health of the unborn child under Section 12, Article II of the Constitution..
WON RH Law violates the right to life and health of the unborn child under Section 12, Article II of the Constitution..
Ruling:
Yes.
Section 12. The State
recognizes the sanctity of family life and shall protect and strengthen the
family as a basic autonomous social institution. It shall equally protect the
life of the mother and the life of the unborn from conception.
The Constitution affords
protection to the unborn from conception. The State shall provide equal
protection to both the mother and the unborn child from the earliest
opportunity of life, that is, upon fertilization or upon the union of the male
sperm and the female ovum. Contraceptives that kill or destroy the
fertilized ovum should be deemed an abortive and thus prohibited. Conversely,
contraceptives that actually prevent the union of the male sperm and the female
ovum, and those that similarly take action prior to fertilization should be
deemed non-abortive, and thus, constitutionally permissible.
Fertilization is sacred
because it is at this stage that conception, and thus human life, begins. Human
lives are sacred from the moment of conception, and that destroying those new
lives is never licit, no matter what the purported good outcome would be.
El Nido, known for its white beaches, dive sites and haven for marine life was my last vacation before I entered Law School (yes you read that right. HAHA) I was hesitant at first to book a flight here because everyone said PALAWAN is for filthy rich people. As you know, I don't have that much but I still did hit the 'book this flight' button. I was also considering the situation of Boracay that time, I knew that tourists will divert their flight here but as you see, I didn't mind it.
Originally, the plan was to take a vacation here with my main but shit happened to us, I can't save the relationship anymore but I can still save this trip, and I did. :)
Every stress that work, admission for law school and lovelife(?) had brought me over the past few weeks was blown and washed away by El Nido. I thank God for this beautiful creation.

TIPS/EXPERIENCES
1.) When I first stepped my foot in El Nido, the tricycle drivers were already asking where I will be headed. I told them to dropped me off Mochileros and the driver charged me for 50 pesos, I reacted and said I'll find a new one. The driver then approved for the minimum fare, I was kind enough to give him 20 pesos. Again, don't be fooled by the tricycle drivers, minimum fare is 10 pesos.
2.) Rent a motorbike if you want to visit Nacpan Beach, it's much cheaper and you can have your sidetrips.
3.) Food here is pricey, prepare an extra money for that. :)
4.) Book your tours at Klook! You'll save much if you do that.
5.) I have experienced Tour A and Tour C, so far, i enjoyed Tour A. I'll definitely go back to El Nido for Tour B and Tour D. :D
6.) There is a bank in El Nido (BPI), but i suggest you to have a cash on hand or withdraw already your money at Puerto Princesa.
7.) You need to have an extra cash for Tour A, kayak fee is not included in the package price, you'll need to pay a total of 400 pesos for the kayak(small lagoon-200, big lagoon-200)
8.) Most of your time will be spent on your boat. You will just spent at most 45-minutes in every island.
9.) Please, please, please, enjoy their underwater. Snorkel and go freediving.

10.) I was very overwhelmed with what El Nido offered me, it was such a beauty. Take a lot of photos, don't hesitate to ask somebody to do that for you, especially your tour guides, they take good shots. Haha
THAT'S IT! I HOPE TO SEE YOU IN EL NIDO NEXT TIME! <3

TIPS:
1.) I recommend you to visit Kermit Resto (Italian resto, pricey pero worth it, GWAPITOS store is also located here)
2.) Rent a motorbike, mas matipid. Fare for each travel in a habal2x is 20pesos and night rate is at 50php, so it's better to rent and ride your own motorcycle.
3.) Every night is party night in Siargao. Ask the locals for the schedule of the parties.
4.) If you want to learn how to surf, i suggest you to hire a guide from Kermit, a one hour supervision is enough for you to learn (500 pesos). Then the next days, just rent a board (which is cheaper because you will not pay for a guide anymore, around 200-300 per day). You can surf all you want with this setup. It's more fulfilling if you ride on a wave just by yourself. Trust me. Haha
5.) The most famous surfing spot is at Jacking Horse which is just beside Cloud 9 but there are still lots of good surfing spots; again, just ask the locals. :)
6.) There are ATM machines in Dapa (also one ATM in General Luna) but most of the time they do not work with foreign ATM cards and credit cards. If you want to extend your stay in Siargao, like what we did by my SO, GL has Palawan Express, magpadala ka nalang ng pera from your family or friends. Hahaha. Bayaran mo nalang pag uwi mo.
7.) Having extra cash is a must every travel, especially here in Siargao where ATMs are scarce.
